GearTrybe Terms of Service
Effective Date: October 8, 2026
These Terms of Service ("Terms") govern your access to and use of GearTrybe.com and any related services, programs, memberships, rewards, purchases, and GearTrybe Flex transactions offered by Gear Trybe, Inc. d/b/a GearTrybe ("GearTrybe," "we," "us," or "our").
By accessing our website, creating an account, purchasing merchandise, enrolling in a GearTrybe Membership, participating in GearTrybe Flex, or using any other GearTrybe service, you agree to these Terms and our Privacy Policy and any additional policies or terms referenced here.
If you do not agree to these Terms, you should not use the GearTrybe website or services.
1. About GearTrybe
GearTrybe is an online sporting-goods platform that allows customers to purchase sporting goods and, on selected eligible products, participate in the GearTrybe Flex program.
Some products sold through GearTrybe may be fulfilled or shipped directly by third-party suppliers, manufacturers, distributors, or fulfillment partners.
The availability of products, brands, pricing, membership benefits, Flex eligibility, shipping methods, and return terms may vary by product and supplier.
2. Eligibility and Accounts
You must be at least eighteen (18) years old or the age of legal majority in your jurisdiction to create an account, purchase a GearTrybe Membership, or enter into a GearTrybe Flex transaction.
A parent or legal guardian may purchase products for a minor and remains responsible for the account, purchase, Membership, Flex obligations, and payment obligations associated with that transaction.
You agree to provide accurate, complete, and current account and payment information.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
3. GearTrybe Membership
GearTrybe currently offers one primary consumer membership ("GearTrybe Membership").
The current membership price is:
$10 per month, paid annually as a $120 annual charge.
Membership benefits may include:
- Private member pricing on eligible products;
- A $60 annual GearTrybe Flex Credit;
- Access to eligible GearTrybe Flex products;
- Member switch pricing on qualifying Flex transactions;
- GearTrybe Rewards benefits; and
- Other member benefits that GearTrybe may offer from time to time.
Membership benefits do not apply to every product. Certain brands, suppliers, categories, or products may be excluded or may have different limitations.
4. Membership Billing and Automatic Renewal
GearTrybe Membership is billed annually at the price disclosed at enrollment. The current annual price is $120.
Unless otherwise stated at the time of enrollment, your Membership automatically renews for additional annual periods using the payment method associated with your Membership.
By enrolling in GearTrybe Membership, you authorize GearTrybe and its payment processors to charge the applicable recurring Membership fee to your payment method at each renewal.
You may cancel future automatic renewal at any time using any cancellation method GearTrybe makes available through your account or by contacting:

Cancellation stops future renewal but does not automatically terminate benefits during a Membership period that has already been paid for.
Except where required by applicable law, Membership fees already paid are non-refundable and are not prorated.
GearTrybe will provide any renewal reminders, disclosures, cancellation mechanisms, or notices required by applicable law.
5. Private Member Pricing
GearTrybe members may receive private pricing on eligible products.
Because certain manufacturers or brands restrict how discounted pricing may be publicly advertised, private member pricing may only be visible after an eligible member signs into their GearTrybe account.
Member pricing:
- May differ by product or brand;
- May not be available on every product;
- May change over time;
- May be subject to supplier or manufacturer pricing policies; and
- May not be combinable with all promotions or discounts.
The final price presented and accepted at checkout controls the applicable purchase.
6. GearTrybe Flex
GearTrybe Flex ("Flex") is a membership benefit available on selected eligible products.
Flex allows an eligible member to pay the applicable amount displayed at checkout, use the product for the applicable Flex period, and later either:
- Keep the product by completing the applicable remaining payment; or
- Return the product in accordance with the Flex return requirements before the applicable final billing deadline.
Unless otherwise disclosed for a specific transaction, eligible Flex products may be used for up to 10 months.
Not every GearTrybe product is eligible for Flex. Flex eligibility will be identified on the applicable product page or during checkout.
7. Flex Payments and Final Balance
Every Flex transaction may include:
- An initial Flex payment;
- Applicable taxes;
- Applicable shipping or related charges; and
- A remaining product balance if the customer keeps the product.
The specific amounts applicable to your Flex transaction will be disclosed before you complete the transaction.
If an eligible Flex item is not timely returned in accordance with the applicable Flex instructions, GearTrybe may automatically charge the remaining product balance shown for that transaction.
Once the applicable remaining balance has been successfully paid, the product becomes yours and is no longer subject to the Flex return option.
8. Authorization for Future Flex Charges
By entering into a Flex transaction, you expressly authorize GearTrybe and its payment processors to charge your payment method for amounts disclosed as part of that Flex transaction, including any applicable remaining product balance due on the final billing date.
You are responsible for maintaining a valid payment method while a Flex transaction remains outstanding.
If a payment fails, GearTrybe may retry the payment, contact you for updated payment information, suspend Membership or Flex privileges, require return of the equipment, or take other commercially reasonable action permitted by law.
9. Maintaining Membership During a Flex Transaction
An active GearTrybe Membership is required to participate in Flex.
Cancelling future Membership renewal does not cancel or eliminate existing Flex obligations.
If your Membership would otherwise expire while Flex equipment remains outstanding, GearTrybe may require you to resolve the Flex transaction, including by returning the equipment in accordance with the applicable instructions or paying the applicable remaining balance.
10. $60 Annual Flex Credit
Each qualifying annual GearTrybe Membership currently includes one $60 Flex Credit per Membership year.
The Flex Credit may be applied toward an eligible Flex transaction as shown at checkout.
Depending on the product and transaction, the Flex Credit may reduce the amount due for the gear at the time of the Flex transaction, including potentially reducing the eligible gear payment to $0.
A "$0 today" or similar Flex offer refers only to the applicable gear payment after the Flex Credit or other applicable benefit is applied. It does not mean that the GearTrybe Membership itself is free.
The effect of the Flex Credit on the initial payment and any remaining product balance will be shown as part of the applicable transaction.
Unless GearTrybe expressly states otherwise:
- The Flex Credit may be used once per Membership year;
- The Flex Credit has no cash value;
- The Flex Credit is not transferable;
- Unused Flex Credit may not be redeemed for cash;
- Once applied to a completed Flex transaction, the Flex Credit is considered used; and
- A Flex return does not automatically restore or refund the Flex Credit.
GearTrybe may restore a Flex Credit when GearTrybe determines that a transaction was cancelled or reversed before fulfillment or in other circumstances expressly approved by GearTrybe.
11. Flex Returns and Switching Gear
A qualifying Flex item may be returned before the applicable final billing deadline in accordance with the return instructions provided for that transaction.
The applicable return deadline and required return event, such as carrier acceptance, shipment, or GearTrybe's receipt of the item, will be identified in the return instructions or account information provided for the Flex transaction.
Returned Flex equipment must:
- Include all required components and accessories;
- Be free from unauthorized modification;
- Not show abuse, intentional damage, or excessive damage;
- Not have missing material components; and
- Otherwise comply with the applicable Flex return requirements.
Normal sporting use may be permitted, subject to the applicable Flex condition requirements.
GearTrybe reserves the right to inspect returned Flex equipment and reject a Flex return that does not satisfy the applicable requirements, subject to applicable law.
12. Flex Payments Are Not Refundable Returns
A Flex return is different from a standard merchandise refund.
Except where required by law, amounts already paid as the initial Flex payment are non-refundable.
The primary financial benefit of an approved Flex return is that the customer avoids the applicable remaining product balance that otherwise would become due.
An eligible member may then purchase or Flex another qualifying product using the member or switch pricing offered at that time.
13. Standard Merchandise Purchases
Products not purchased through Flex are standard merchandise purchases.
A product being Flex eligible does not necessarily require a customer to use Flex. Where GearTrybe offers both options, customers may choose to purchase the item normally.
Prices, availability, promotions, and product eligibility may change without notice before an order is completed.
14. Third-Party Fulfillment
GearTrybe may use manufacturers, distributors, Shopify Collective suppliers, and other third parties to store, fulfill, and ship products.
As a result:
- Items in the same order may ship separately;
- Different products may have different return requirements;
- Shipping times may vary by supplier;
- Inventory availability may change; and
- Supplier-specific restrictions may apply.
15. Standard Returns and Refunds
Standard merchandise returns are subject to the return terms displayed for the applicable product and GearTrybe's Return Policy.
Return windows, required product condition, restocking fees, return shipping charges, and other requirements may vary by product or supplier.
For discretionary returns of supplier-fulfilled merchandise, and except where applicable law requires otherwise, GearTrybe issues the applicable merchandise refund after:
- The applicable supplier approves the return; and
- GearTrybe receives the corresponding supplier refund or account credit.
Where permitted by law, an approved refund may be reduced by:
- Supplier restocking fees;
- Non-refundable original shipping;
- Return shipping charges; or
- Other amounts not refunded or credited to GearTrybe.
If a supplier determines that a discretionary return does not meet its applicable return requirements, GearTrybe is not obligated to independently fund a refund denied by the supplier, except where applicable law requires otherwise.
Nothing in these Terms is intended to limit any non-waivable rights you may have under applicable law concerning defective, damaged, incorrect, misdescribed, recalled, or otherwise legally nonconforming merchandise.
16. Shipping
Shipping charges, estimated delivery dates, and available shipping methods will be displayed when available during the purchase process.
Delivery dates are estimates unless GearTrybe expressly guarantees a specific delivery date.
GearTrybe is not responsible for delays caused by carriers, suppliers, weather, natural disasters, government action, or other events outside GearTrybe's reasonable control, subject to applicable law.
17. GearTrybe Vault Points and Rewards
GearTrybe may operate a rewards program through which customers earn "Vault Points" on qualifying transactions.
Earning rates may vary by product, transaction, customer status, promotion, or other program rules.
Estimated points shown before purchase are estimates. Final points are determined based on the qualifying completed transaction.
Returns, refunds, cancellations, chargebacks, fraud, or other transaction reversals may result in corresponding Vault Points being removed or reversed.
18. 2,000-Point Membership Reward
Under the current GearTrybe Rewards program, a qualifying customer who is not already a GearTrybe member may earn toward a 2,000 Vault Point reward.
Upon satisfying the applicable reward requirements, 2,000 Vault Points may be redeemed for a one-year GearTrybe Membership, currently a $120 value.
Redemption may require the customer to maintain an active and valid GearTrybe account and satisfy any applicable verification requirements.
19. Member Vault Credit Reward
Under the current rewards program, active GearTrybe members continue earning Vault Points.
For participating member accounts, every 500 qualifying Vault Points converts to a $5 GearTrybe Credit.
GearTrybe Credits:
- Are promotional/store credits and are not cash;
- Cannot be transferred unless GearTrybe expressly permits it;
- May be subject to product or transaction restrictions;
- May not be redeemable for cash except where required by law; and
- Are subject to the reward terms displayed in the customer's account.
20. Changes to Rewards Programs
GearTrybe may modify, suspend, or discontinue its rewards program, earning rates, redemption options, or benefits from time to time, subject to applicable law and any notice requirements that apply.
Any change will apply as described in the notice or updated program terms.
21. Product Information
GearTrybe attempts to provide accurate product descriptions, images, specifications, availability, pricing, and other information.
Product colors, images, specifications, packaging, models, or minor details may vary from what appears online.
GearTrybe may correct errors, inaccuracies, or omissions and may cancel or modify an order affected by an obvious pricing or listing error, subject to applicable law.
22. Manufacturer Warranties
Certain products may include warranties offered by their manufacturer. Any manufacturer warranty is governed by the terms established by that manufacturer.
GearTrybe does not independently expand or replace a manufacturer's warranty unless GearTrybe expressly agrees to do so in writing.
23. Prohibited Conduct
You agree not to:
- Provide false or misleading account information;
- Engage in fraud or attempted fraud;
- Use stolen or unauthorized payment methods;
- Circumvent Membership or Flex requirements;
- Manipulate Vault Points, credits, discounts, or promotions;
- Abuse GearTrybe return or Flex programs;
- Fail to return Flex equipment while attempting to avoid payment;
- Resell, transfer, or misuse benefits contrary to applicable program terms;
- Interfere with the operation or security of the GearTrybe website;
- Use automated systems to scrape or misuse GearTrybe content; or
- Use GearTrybe for unlawful activity.
GearTrybe may suspend accounts, cancel benefits, reverse rewards, reject transactions, or terminate accounts when reasonably necessary to protect GearTrybe, its suppliers, customers, or payment systems from fraud, abuse, or violations of these Terms.
24. Intellectual Property
The GearTrybe name, trademarks, logos, website design, graphics, text, software, and other proprietary materials are owned by or licensed to GearTrybe and are protected by applicable intellectual property laws.
Nothing in these Terms gives you ownership of GearTrybe intellectual property.
25. Third-Party Services
GearTrybe may use or link to services operated by third parties, including payment processors, financing providers, shipping providers, manufacturers, suppliers, and technology platforms.
Your use of a third-party service may also be subject to that provider's terms and privacy practices.
26. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GEARTRYBE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED, GEARTRYBE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
NOTHING IN THIS SECTION DISCLAIMS WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.
27. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEARTRYBE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, PRODUCTS, MEMBERSHIP, FLEX, OR REWARDS PROGRAM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEARTRYBE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID DIRECTLY TO GEARTRYBE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain exclusions or limitations, so some of these limitations may not apply to you.
28. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless GearTrybe and its officers, directors, employees, affiliates, and agents from claims, damages, losses, liabilities, and reasonable expenses resulting from your unlawful use of the Platform, fraud, misuse of GearTrybe programs, or material violation of these Terms.
29. Suspension and Termination
GearTrybe may suspend or terminate an account or program benefit for fraud, abuse, repeated payment failure, material violation of these Terms, unlawful conduct, or conduct that materially threatens GearTrybe, its customers, suppliers, or systems.
Termination of an account or Membership does not eliminate payment obligations or other obligations arising from transactions completed before termination.
30. Changes to These Terms
GearTrybe may update these Terms from time to time.
When required by applicable law, GearTrybe will provide notice of material changes before they become effective.
Updated Terms will include a revised effective date.
Your continued use of GearTrybe after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by applicable law.
31. Governing Law
These Terms are governed by the laws of the State of [INSERT GOVERNING STATE], without regard to its conflict-of-law rules, except to the extent federal law or other applicable law requires otherwise.
32. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT MAY AFFECT YOUR RIGHT TO HAVE A DISPUTE HEARD IN COURT.
Except for claims eligible to be brought in small claims court and requests for temporary or injunctive relief, disputes arising from these Terms or the GearTrybe services may be resolved through binding individual arbitration to the extent permitted by applicable law.
The arbitration provider, applicable rules, location, allocation of fees, opt-out rights, and any class-action waiver should be stated in GearTrybe's final arbitration provision.

33. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
34. No Waiver
GearTrybe's failure to enforce a provision of these Terms does not waive its right to enforce that provision or any other provision later.
35. Entire Agreement
These Terms, together with the policies and transaction-specific terms incorporated by reference, constitute the agreement between you and GearTrybe regarding the services covered by these Terms.
If transaction-specific terms displayed at checkout expressly conflict with these general Terms, the transaction-specific terms will control for that transaction to the extent of the conflict.
